Terms & Conditions

User's agreement to the terms, conditions, and limitations below are a condition precedent to any sale and/or contract between Vorshlag, LLC and User, or to any use of Vorshlag, LLC's products, parts, or advice:

Order Processing Times & Deadline

Vorshlag, LLC strives diligently to ship all orders out on the same day they were received. All online or phone-in orders received before 3 pm CST will ship out that same business day, unless there is a backorder on a part or a similar delay. We notify customers that have ordered parts that are on backorder within 1-4 business hours, asking them if they would like to wait (with an ETA) or if they want to cancel the order. If you absolutely need something overnighted that day please call us to verify stock before you order. Please see our posted business days and hours at the top of the website. If we are closed on a normal business day for some reason it will be posted above.

Payment

Vorshlag, LLC requires all payments in U.S. Dollars. We accept Visa, MasterCard, American Express and Discover credit cards as payment. In addition, Visa and MasterCard check cards are accepted forms of payment. Check cards will be processed as credit cards, NOT as debit / ATM cards. Certified Bank checks, Cashier's checks or money orders can also be accepted on a case by case basis. Personal checks are accepted, but order shipment will be delayed until the check clears (up to 12 business days). PayPal is not accepted, due to their high transaction fee rates.

Warranty

Parts manufactured by Vorshlag, LLC are intended for off-road or competition use only, and are sold "as is" without any warranty whatsoever. Vorshlag, LLC makes no warranty, express or implied, of any kind regarding its products. Any and all implied warranties of merchantability, or fitness for any purpose, etc., are also expressly excluded. The entire risk as to quality, fitness for application, and performance is with the buyer and the buyer expressly assumes such risk. Should such accessories prove defective, the buyer assumes the entire cost of all necessary service and repair.

Limited Liability

COMPETITION COMPONENTS ARE OFTEN USED IN WAYS UNANTICIPATED AND UNANTICIPATABLE BY THEIR MAKERS, AND CONSTANTLY PUSHED BEYOND THEIR LIMITS AND OFTEN MISUSED. Vorshlag, LLC WILL NOT BE LIABLE FOR ANY LOSS, DAMAGE (DIRECT OR INDIRECT, CONSEQUENTIAL, FORSEEABLE, OR OTHERWISE) ARISING FROM THE USE OF ITS PRODUCTS, FROM INABILITY TO DETERMINE THE USE OF THE PRODUCT, OR OTHERWISE. BEFORE USING, THE USER SHALL DETERMINE THE SUITABILITY OF THE PRODUCT FOR ITS INTENDED USE, AND THE USER SHALL DETERMINE AND ASSUME ANY AND ALL RISKS THAT MAY ARISE IN CONNECTION WITH ITS USE.

Indemnity

USER FURTHER AGREES TO INDEMNIFY, DEFEND AND HOLD HARMLESS Vorshlag, LLC, ITS SUBSIDIARIES AND AFFILIATES, THEIR DIRECTORS, OFFICERS, AGENTS AND EMPLOYEES FROM AND AGAINST ANY AND ALL LIABILITIES, CLAIMS, FINES, PENALTIES, DEMANDS, CAUSES OF ACTION, LOSSES, DAMAGES, EXPENSES AND REASONABLE ATTORNEYS' FEES, WHETHER KNOWN OR UNKNOWN, VESTED OR CONTINGENT, REGARDLESS OF WHETHER OR NOT IT IS CAUSED IN PART BY A PARTY INDEMNIFIED HEREUNDER AND REGARDLESS OF WHETHER OR NOT IT IS CAUSED IN PART BY THE NEGLIGENCE OF A PARTY INDEMNIFIED HEREUNDER, THAT ARISE OUT OF OR RESULT FROM USER'S APPLICATION OR USE OF Vorshlag, LLC COMPONENTS.

Street Legality

Aftermarket parts are intended to modify or prepare a vehicle for uses which may vary from conditions anticipated by the vehicle manufacturer. Vehicles modified with some Vorshlag, LLC manufactured accessories may no longer be legally used on public roads. Check your federal, state and local laws before installing Vorshlag, LLC manufactured accessories on vehicles intended for use on public roads.

Federal and state laws may prohibit removing, modifying, or rendering inoperable any device or element of design of the pollution control device or system on any motor vehicle used on public highways.

Vorshlag, LLC makes no representations or warranties regarding compliance of a vehicle using its parts with any law, regulation of any jurisdiction.

Damaged or Lost Merchandise

Merchandise damaged or lost in transit is the sole responsibility of the carrier. Vorshlag, LLC inspects all merchandise prior to shipment and packages it securely. It is your responsibility to inspect it completely while the delivery driver is present and have him/her note any damages. If damages are found after delivery, call the carrier immediately for an inspection. DO NOT return any damaged parts to Vorshlag, LLC If you do, the carrier may not honor your claim and the loss will become the responsibility of the customer.

Refused Shipments

If a shipment is refused by the customer without prior written consent from Vorshlag, LLC, the customer's account will be credited for the items ordered, charged a $20 handling fee and charged for freight expenditures from Vorshlag, LLC to the customer along with any return freight expenses.

Adult signature required for deliveries

Unless receiving prior written consent from Vorshlag, LLC, all shipments to the customer from Vorshlag, LLC will be sent requiring an Adult Signature for delivery. Several delivery attempts will be made per the shipping companies' policies. If the delivery is returned to Vorshlag, LLC by the shipping company, the customer's account will be credited for the items ordered and charged for freight expenditures from Vorshlag, LLC to the customer along with any return freight expenses. If, with prior written approval by Vorshlag, LLC, the shipment was made without an adult signature required, Vorshlag Motorsports will not be responsible in any way for loss or damage of the shipment after delivery.

Core Exchange and Credit Policy

Very few Vorshlag parts require core charges - almost everything we sell is a brand new part. However, all orders requiring a product core return will be assessed the full core charge. Credit to the customer's account for the returned core will be issued subject to the following:

  • Returned cores must be the exact type specified by Vorshlag, LLC
  • Returned cores should be fully assembled. Disassembled cores must include all parts. Incomplete cores may receive partial or no credit at the discretion of Vorshlag, LLC
  • Customer is responsible for shipping charges to return core to Vorshlag, LLC
  • Returned cores must be in a rebuildable undamaged condition as defined by Vorshlag, LLC Cores not meeting these criteria may be rejected by Vorshlag, LLC
  • All core returns must be postmarked within 20 calendar days of our invoice date for full credit. Cores received by Vorshlag, LLC that are postmarked after 20 calendar days may be rejected.
  • Credits for returned cores will only be made after examination of the returned core - typically within 5 days of receipt. Customers will be notified of the condition of the core and the total amount of credit within 10 days of receipt.
  • Customer may request the return of rejected core. Customer is responsible for all shipping charges from Vorshlag, LLC to the customers address.
  • Cores returned to Vorshlag, LLC COD will not be accepted.
  • Vorshlag, LLC decisions regarding returned cores and core credits are final.



Return Policy

Contact Vorshlag, LLC for a RMA # prior to shipping. RMA # must be clearly written on the package. Returned products WILL NOT be accepted without prior authorization. Any unauthorized charge backs for items purchased via credit card will be viewed as theft and prosecuted fully. All returns must include a copy of the original invoice and return shipping must be prepaid. Returns made COD will NOT be accepted. Returns may be subject to a 20% restocking fee at the discretion of Vorshlag, LLC. All items returned must be in perfect "new" condition in the original packaging. Use all of the wrapping materials we used to get the part to you - or more. All returns must be made within 30 days of original receipt of shipment by the customer. Vorshlag, LLC cannot accept any electrical and or fuel injection components, special order or close out items, or items that have already been installed on a vehicle for refund or exchange.

International Orders

Vorshlag, LLC accepts and ships international orders to most countries. For shipping quotes please create an account using our online shopping cart system and several shipping options and costs will be generated automatically before the order must be confirmed or paid for.

If you live in a country that a certain former U.S. President had labeled an "Axis of Evil" member you probably don't want anything we sell anyway, and we likely will not ship to you (Iran or North Korea). If your country is run by an oppressive dictatatorial government that has been charged with international crimes such as genocide, you probably don't even have roads and do not want our products anyway, but we could also chose not to take your order. Lastly the country of Singapore is on our "banned" list of countries we do business with because we've been ripped off by people there. Sorry to you honest folks in Singapore, but a few criminals there have ruined it for the rest of you. We will contact people in these few banned countries that have attempted to order online and return your funds as soon as possible.

International customers will always be responsible for their applicable in-country taxes, customs and import duties. DO NOT ask us to make falsified "gift receipts" to help you get out of paying VAT or similar import taxes in your country. We do not break international laws to save you on your import taxes, so don't ask.

General

All prices, specifications, operating procedures, technical details and/or availability are subject to change without notice. Notification of changes will be given prior to shipping. Vorshlag, LLC does not take responsibility for any typographical errors or accidental omissions.

Handling Charges

A small handling fee will be added to all shipped purchases. This pays for basic packaging materials (boxes, tape, etc), and the handling fees we access are very low by industry standards. If you pick up items from our location or in person at a race event and request it with no box, then this line item will not be charged. Otherwise, the charges below are added once to each individual order.

If any large or very heavy items require an additional shipping charge or freight truck shipping arrangements, it will be listed in the product listing on the online catalog.
(IE: Hoods, Fenders, Bumpers, Engines, LS1 swap kits, etc....... )

Shipping

Shipping charges for our products are determined by the individual weight of the product using UPS and USPS shipping modules and our best discounted rates. The preferable shipping method is via UPS Ground, with USPS being the alternate shipping method. UPS services will not ship to PO, APO, or FPO Boxes, but USPS will ship to APO for our military customers abroad. Faster service is available at additional cost - please see the online shipping options for a rapid quote via multiple choices. If there is no preference made on phoned-in orders, Vorshlag, LLC will select the shipping method for the buyer. Damage resulting from shipping will be remedied only if it is reported to the delivery driver immediately. Vorshlag, LLC will not be responsible for any extra shipping charges that may arise from re-shipping where the recipient (Buyer) was not present to accept the goods, or lift-gate charges on undeliverable addresses.

Taxes

Shipments within the state of Texas will be charged sales tax on all merchandise and freight. The rate is 8.25%
